Kolejne nakazy aresztowania wydane przez MTK - tym razem wobec Szojgu i Gierasimowa

Wczoraj Międzynarodowy Trybunał Karny wydał kolejne nakazy aresztowania dotyczące sytuacji w Ukrainie. Wczorajsze nakazy dotyczą dwóch osób: Ministra Obrony Federacji Rosyjskiej Siergieja  Szojgu i Szefa Sztabu Generalnego Sił Zbrojnych Federacji Rosyjskiej Walerego Gierasimowa i rzekomych zbrodni międzynarodowych popełnionych od co najmniej 10 października 2022 r. do co najmniej 9 marca 2023 r.

Zarzuca się im odpowiedzialność za zbrodnię wojenną polegającą na kierowaniu ataków na obiekty cywilne (tj. naruszenie art. 8 ust. 2 lit. b) pkt (ii) Statutu Rzymskiego) oraz zbrodnię wojenną polegającą na spowodowaniu nadmiernych przypadkowych szkód wśród ludności cywilnej lub szkód w mieniu cywilnym (tj. naruszenie art. 8 ust. 2 lit. b) pkt (iv) Statutu Rzymskiego) oraz zbrodnię przeciwko ludzkości polegającą na popełnieniu innych czynów nieludzkich regulowanych w art. 7 ust. 1 lit. k  Statutu Rzymskiego.

 Serdecznie  zapraszamy na konferencję organizowaną przez Centrum Badań nad Prawem Migracyjnym Instytutu Nauk Prawnych PAN pt. „Polskie prawo migracyjne w obliczu wyzwań związanych z zarządzaniem migracjami, dostępem do ochrony międzynarodowej i granicami”.

2. Call for papers: Research Colloquium "Global Transformations: The International System at a Crossroads?" (październik 2024 r.)

W dniach 25-27 października br. odbędzie się Research Colloquium "Global Transformations: The International System at a Crossroads?" Zaproszenie skierowane jest do młodych badaczy i studentów.

Wystąpienia mogą dotyczyć zwłaszcza następujących tematów:

• Wars and their re-occurrence in Europe (incl. the widespread ignorance of wars in other world regions),
• Digitalisation (e.g., regarding the increased importance of stable and safe communication in economic, legal, and social terms),
• The growing importance of universal cooperation in solving global problems (e.g., in tackling climate change),
• The increased influence of the Global South (closely associated with the need for a revaluation of North-South relations),
• Ideas and concepts discussed at the Summit of the Future,
• The role of international judicial bodies in transformations, in particular through the clear definition of obligations (e.g., in the small islands cases before the ICJ and ITLOS, or the preliminary procedures under the Genocide Convention between South Africa and Israel).

3. Call for papers: International Young Scholars Conference on Space Law "Space Exploration, Space Exploitation: Opposite directions or parallel tracks? Searching for answers at a turning point in space law" (Ateny, wrzesień 2024 r.)

W dniu 9 września br. w Atenach odbędzie się konferencja "Space Exploration, Space Exploitation: Opposite directions or parallel tracks? Searching for answers at a turning point in space law".

Wystąpienia mogą dotyczyć m.in. następujących zagadnień:

- The adequacy of the law in force to regulate and promote both exploration and use of outer space;

- The role of law in the sustainable and peaceful use of space - both de lege lata and de lege ferenda;

- The integrative, instead of oppositional, approach to space exploration and use: 'commercial exploration' in relation to and implications for space law;

- Use and abuse of space: The problem of space debris;

- To the Moon and beyond: An effective legal framework for the establishment of permanent facilities on celestial bodies;

- Differentiated legal approaches for divergent uses: Are there any uses of space that are prohibited by law? What are the limits of the principle of freedom and use?

- The new face of space exploration: human and robotic spaceflight, planetary protection, search for extraterrestrial life: Do we have adequate rules?

Zaproszenie na seminarium “State immunity and immunities of State officials in times of transformation”

 W imieniu projektu Sunflowers zapraszamy na seminarium, 24 czerwca o 18.00, szczegóły poniżej: Join us, virtually, on the 24th of June 2024, Monday, at 6:00 PM CET, for the zoom webinar entitled: “State immunity and immunities of State officials in times of transformation”.

The topic will be presented by Professor Anna Wyrozumska, who is professor of international law and European Union law, University of Lodz, Poland and the President of the Legal Advisory Committee in the Ministry of Foreign Affairs, former member of the Polish delegation at the Rome Conference on the Establishment of an International Criminal Court.

The second speaker will be Professor Magdalena Matusiak-Frącczak, habilitated doctor, attorney, Assistant Professor (University of Lodz, Poland), visiting professor (Chandigarh University, India).

 

The webinar focuses on various types of exemptions that come from international law from the jurisdiction or enforcement of the state law, i.e. immunities available to states, persons or international organizations. Immunities are available to different entities and have different scope and effects. The institution of immunities, in particular state immunity, finds its justification in the basic principles of the international law system. At the same time, immunities set the framework for mutual relations between states in the exercise of jurisdiction. Contemporary changes, such as strengthening the position of the individual, in particular the protection of his/her fundamental rights, or the increasingly frequent entry of the state into private law relations, make the subject of this study one of the most widely discussed issues in the doctrine of international law. The question therefore arises to what extent immunities must remain inviolable in the interest of maintaining international order and ensuring the efficient functioning of a state in international relations, and to what extent they should be limited, e.g. in the interest of protecting the individual, including the protection of his/her fundamental rights.

The meeting will be moderated by Professor Aleksandra Mężykowska, who is an Associate Professor at the Institute of Legal Studies of the Polish Academy of Sciences, and also a Board Member of the Register of Damage Caused by the Aggression of the Russian Federation against Ukraine and legal expert at the Ministry of Foreign Affairs.

The webinar will be conducted in English and simultaneous translations into Ukrainian will be available.
